1.2. These Terms and Conditions of Use (the “Terms”) govern your access to and use of the SUNFIBRE website available at the domain sunfibre.com and any related sub‑domains or online interfaces controlled by SUNFIBRE (collectively, the “Website”), as well as the online services provided via the Website (the “Services”).
1.3. By accessing or using the Website or the Services in any manner, including merely browsing the Website, creating an account or uploading any content, you agree to be bound by these Terms.
2. Acceptance of the Terms and Eligibility
2.1. By accessing or using the Website or the Services, you acknowledge that you have read, understood and agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Website or the Services.
2.2. You may use the Website and the Services only if you are at least 18 years old and have full legal capacity. By using the Website or the Services, you represent and warrant that you are 18 years of age or older and that you have full capacity to enter into a legally binding agreement.
2.3. If you access or use the Website or the Services on behalf of a legal entity (for example, your employer), you represent and warrant that you are authorised to bind such entity and that the entity agrees to be bound by these Terms. In such case, references to “you” shall be interpreted as references to that entity.
2.4. The processing of personal data is governed by our Privacy Policy available on the Website in the “Privacy Policy” section. The use of cookies and similar technologies is governed by our Cookies Policy, available on the Website in the “Cookies Policy” section.

2.6. You represent and warrant that you are not located in a country subject to international sanctions applicable to SUNFIBRE and that you are not listed on any sanctions list administered by the EU, UN or other relevant authorities.
3. Account Registration and Security
3.1. Certain parts or features of the Services may require you to create a user account (the “Account”). When registering an Account, you must provide accurate, current and complete information and keep it up to date.
3.2. You are responsible for maintaining the confidentiality and security of your login credentials and must not share them with any third party. You are fully responsible for all activities that occur under your Account, whether authorised by you or not.
3.3. You must immediately notify SUNFIBRE of any unauthorised use of your Account or any other breach of security that you become aware of.
3.4. SUNFIBRE may, at its reasonable discretion, suspend or terminate your Account or limit your access to the Services if:
- you violate these Terms or applicable law;
- there is a justified suspicion of abuse, fraud or security breach; or
- your Account has been inactive for an extended period, if such deactivation is reasonable and subject to prior notice where practicable.
3.5. You may terminate your Account at any time by using the relevant functionality on the Website (if available) or by contacting us at the above e‑mail address. Termination of your Account does not affect any rights or obligations that have accrued prior to the termination.
4. Description of the Services
4.1. The Website serves as an online platform through which SUNFIBRE provides information about its products, technologies and solutions, and may provide additional online tools or services, such as user dashboards, project management or communication features, as may be described on the Website from time to time.
4.2. The specific scope, functions and availability of the Services are described on the Website and may differ depending on whether you use a free or a paid tier of the Services, if such tiers are offered.
4.3. SUNFIBRE reserves the right to modify, expand, limit or discontinue the Services or their features at any time, in particular in order to improve functionality, reflect technical developments, or comply with legal requirements. Material changes that significantly affect the use of the Services will be communicated within the Website or by other appropriate means.
5. User‑Generated Content (UGC)
5.1. The Services may allow you to upload, publish, submit, store, transmit or otherwise make available information, data, texts, images or other materials (collectively, “User‑Generated Content” or “UGC”).
5.2. You retain all rights to your UGC that you upload or submit through the Services, subject to the licence granted to SUNFIBRE under these Terms.
5.3. By uploading or submitting any UGC, you represent and warrant that:
- you are the owner of such UGC or have obtained all necessary rights, licences and consents required to upload and use the UGC in connection with the Services and to grant the licence described below;
- the UGC does not infringe any intellectual property rights, privacy rights, publicity rights or other rights of third parties; the UGC does not violate any applicable law or regulation; and
- the UGC is not defamatory, offensive, harmful, misleading, fraudulent or otherwise objectionable.
5.4. By uploading or submitting UGC through the Services, you grant SUNFIBRE a worldwide, non‑exclusive, royalty‑free, transferable and sublicensable licence to host, store, reproduce, modify, adapt, translate, create derivative works from, publicly display, perform, distribute and otherwise use such UGC, solely for the purposes of operating, maintaining, improving, marketing and promoting the Website and the Services.
5.5. This licence is granted for the duration of the intellectual property rights subsisting in such UGC, unless earlier revoked in accordance with mandatory law or specific arrangements between you and SUNFIBRE. Where technically and legally feasible, you may request deletion of your UGC; however, SUNFIBRE may retain copies to the extent necessary for legitimate and lawful purposes, such as compliance with legal obligations or defence of legal claims.
5.6. SUNFIBRE is not obliged to monitor all UGC. However, SUNFIBRE reserves the right, at its discretion, to review, block, remove or disable access to any UGC that it reasonably considers to be in violation of these Terms or applicable law, or to be otherwise harmful or inappropriate.
5.7. If you become aware of any UGC that appears to be unlawful or to violate these Terms, you are encouraged to notify SUNFIBRE using the contact details indicated above. SUNFIBRE will handle such notices in a reasonable manner and in accordance with applicable law.
6. Prohibited Conduct
6.1. When using the Website and the Services, you must not, and must not allow any third party to:
- violate any applicable laws or regulations;
- infringe intellectual property rights, privacy rights or any other rights of SUNFIBRE or third parties;
- interfere with, circumvent, disable or otherwise undermine any security or technical measures of the Website or the Services;
- attempt to gain unauthorised access to any part of the Website, the Services, user accounts or computer systems;
- use automated means (including robots, spiders, scrapers or crawlers) to access the Website or the Services, except as expressly permitted in writing by SUNFIBRE;
- introduce viruses, malware, ransomware, worms, trojan horses or other harmful code;
- use the Website or the Services to send unsolicited communications (spam), phishing messages or other unwanted content;
- upload or disseminate UGC that is unlawful, harmful, defamatory, obscene, hateful, discriminatory, violent, misleading or otherwise inappropriate;
- use the Website or the Services for any purpose other than for which they are intended or in a manner that could damage, disable, overburden or impair them or interfere with their use by others.
7. Intellectual Property of SUNFIBRE
7.1. The Website, the Services and all Content provided by SUNFIBRE (including texts, images, graphics, logos, trademarks, domain names, software, source code and other elements) are protected by intellectual property rights and remain the property of SUNFIBRE or its licensors.
7.2. Subject to your compliance with these Terms, SUNFIBRE grants you a limited, non‑exclusive, non‑transferable and revocable licence to access and use the Website and the Services for your personal or internal business purposes, strictly in accordance with these Terms and within the scope of functionalities provided.
7.3. Except as expressly permitted by these Terms or by law, you must not reproduce, distribute, publicly display, make available, modify, translate, reverse engineer or otherwise create derivative works from any part of the Website, the Services or the Content provided by SUNFIBRE without the prior written consent of SUNFIBRE.
7.4. Any feedback, suggestions or ideas you provide to SUNFIBRE regarding the Website or the Services may be used by SUNFIBRE without any obligation to you, and you hereby grant SUNFIBRE a perpetual, worldwide, non‑exclusive, royalty‑free licence to use such feedback for any legitimate purpose.
8. Links and Third‑Party Services
8.1. The Website and the Services may contain links or provide access to third‑party websites, services, products or content (collectively, “Third‑Party Services”).
8.2. SUNFIBRE does not control and is not responsible for the availability, functionality, content, security or privacy practices of any Third‑Party Services. Your use of Third‑Party Services is at your own risk and is governed by the terms and policies of the respective third parties.
8.3. The inclusion of a link or reference to any Third‑Party Services on the Website does not imply endorsement or recommendation by SUNFIBRE.
9. Suspension and Termination
9.1. SUNFIBRE may suspend or restrict your access to the Website, the Services or your Account, or terminate your Account and these Terms with immediate effect, if:
- you materially breach these Terms or applicable law;
- you repeatedly or seriously infringe the rights of SUNFIBRE or third parties;
- there is a justified suspicion of fraud, abuse or security breach; or
- we are required to do so by law or by a competent authority.
9.2. In less serious cases, SUNFIBRE may first notify you and request that you remedy the breach within a reasonable period. If you fail to remedy the breach within such period, SUNFIBRE may proceed with suspension or termination.
9.3. You may terminate your use of the Services and request deletion of your Account at any time. Termination shall not affect any obligations that have arisen prior to termination, including payment obligations, if any.
9.4. Upon termination of your Account:
- your right to access and use the Account and any associated features will cease;
- SUNFIBRE may delete or anonymise your UGC, unless we are required or entitled to retain it for legitimate purposes, in particular compliance with legal obligations and defence of legal claims.
10. Fees and Payment (if applicable)
10.1. SUNFIBRE may offer certain Services or features free of charge and others on a paid basis. The applicable prices and billing terms shall be specified on the Website or in a separate agreement.
10.2. If you subscribe to paid Services, you agree to pay all fees due in accordance with the applicable pricing information and payment terms. All fees are non‑refundable, except where expressly stated otherwise in these Terms or under mandatory law.
10.3. SUNFIBRE may change the prices or the billing terms for paid Services. Any such changes will be announced in advance in a reasonable manner, and will generally apply from the next billing period. If you do not agree with the new prices, you may terminate the paid Services before the changes take effect.
11. Disclaimer of Warranties
11.1. The Website, the Services and all Content are provided on an “as is” and “as available” basis. To the maximum extent permitted by applicable law, SUNFIBRE disclaims all warranties of any kind, whether express, implied or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title and non‑infringement.
11.2. In particular, SUNFIBRE does not warrant that:
- the Website or the Services will be uninterrupted, secure or error‑free;
- any defects or errors will be corrected;
- the Website, the Services or the Content will be accurate, complete, up‑to‑date or suitable for your particular needs; or
- the Website or the Services will be compatible with your hardware or software.
11.3. Nothing in this Section 11 excludes or limits warranties or rights that cannot be excluded or limited under mandatory law, in particular where you act as a consumer.
12. Limitation of Liability
12.1. Nothing in these Terms excludes or limits SUNFIBRE’s liability:
- for damage caused intentionally or by gross negligence;
- for damage to life, health or bodily integrity; or
- where such exclusion or limitation would be invalid under applicable mandatory law.
12.2. To the maximum extent permitted by law, SUNFIBRE shall not be liable for:
- any indirect or consequential loss or damage;
- loss of profit, revenue, business, contracts, anticipated savings or goodwill;
- loss or corruption of data;
- any damage arising from your reliance on any Content or information obtained through the Website or the Services; or
- any damage arising in connection with any Third‑Party Services.
12.3. If you use the Website or the Services in the course of your business (B2B), the total aggregate liability of SUNFIBRE for any and all direct damages arising out of or in connection with the use of the Website, the Services or these Terms, whether in contract, tort or otherwise, shall be limited to:
- CZK 10,000 (ten thousand Czech crowns), or
- the total amount of fees actually paid by you to SUNFIBRE for paid Services during the twelve (12) months preceding the event giving rise to the liability,
whichever is lower.
12.4. The limitation set out in Section 12.3 shall not apply to the liabilities referred to in Section 12.1 or to any liability that cannot be limited under mandatory law.
12.5. If you are a consumer, your statutory rights remain unaffected.
13. Force Majeure
13.1. SUNFIBRE shall not be liable for failure to perform or any delay in performing its obligations under these Terms if such failure or delay is caused by circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, governmental actions, strikes, lockouts, failures of telecommunications or internet services, or power outages.
13.2. In case of a force majeure event, SUNFIBRE shall take reasonable steps to mitigate its effects and to resume performance as soon as reasonably possible.
14. Privacy and Cookies
14.1. Information on how SUNFIBRE processes personal data, including the purposes of processing, legal bases, retention periods and your rights as a data subject, is set out in the Privacy Policy available on the Website.
14.2. Information on the use of cookies and similar technologies, including the types of cookies used and your options to manage them, is set out in the Cookies Policy available on the Website.
15. Changes to the Website and to the Terms
15.1. SUNFIBRE may modify or update the Website and the Services from time to time, including the Content and technical features, in particular in order to improve user experience, introduce new functionalities or comply with legal requirements.
15.2. SUNFIBRE may amend these Terms. Material changes will be communicated in advance in an appropriate manner (for example by a notice on the Website or via e‑mail, where practicable), indicating the effective date of the amended Terms.
15.3. The amended Terms shall take effect on the date specified in the notice. By continuing to use the Website or the Services after the amended Terms take effect, you agree to be bound by the new version. If you do not agree with the amended Terms, you must stop using the Website and the Services and, if applicable, terminate your Account before the new Terms become effective.
16. Governing Law and Dispute Resolution
16.1. These Terms and any disputes arising out of or in connection with these Terms, the Website or the Services shall be governed by the laws of the Czech Republic, without regard to its conflict‑of‑laws rules.
16.2. The courts of the Czech Republic shall have jurisdiction over any such disputes. The locally competent courts shall be determined in particular by the registered seat of SUNFIBRE.
16.3. If you are a consumer residing in a Member State of the European Union, you shall not be deprived of the protection afforded to you by mandatory provisions of the law of your country of residence.
17. Consumer Information – ADR and ODR (EU)
17.1. If you are a consumer, you may have the right to seek out‑of‑court (alternative) dispute resolution. In the Czech Republic, the competent authority for consumer disputes arising from contracts concluded online or related to the provision of services is, in particular, the Czech Trade Inspection Authority (Česká obchodní inspekce).

18. Language Versions
18.1. These Terms are drawn up in the English language. A Czech version may also be made available on the Website. In case of discrepancies between language versions, the Czech version shall prevail, unless SUNFIBRE explicitly states otherwise.
